John LaPean, alias Jack LaPean, alias John Burke, alias John Buchanan, appellant, hereinafter referred to as defendant, was charged, together with Peter Bachmeyer and Ralph Green, with having killed and murdered Ray Robeson in the city of Eau Claire on the 20th day of March, 1938. The information also charged four previous sentences unreversed of record. On motion, defendant was granted a separate trial. April 1, 1944, the jury found the defendant guilty of murder in the first degree. He was sentenced to life imprisonment in the states prison at Waupun. Defendant appeals.
