Held that inadvertent errors in the charge not brought to the attention of the court at the trial will not be considered on appeal, and that where a party acquiesces in the statement of the law as contained in the charge he is precluded from asserting that the theory on which the case was submitted to the jury was erroneous unless it is conclusively shown by the record that the successful party was not entitled to recover.
